Special Indemnification - Gentex
Purchase of the Gentex Rear Camera Display system from Brandsport LLC will serve as the customer's implied agreement to the following:
1. Indemnification. Customer shall indemnify, hold harmless and defend against any claims or demands for injury or death to persons, property damage, economic loss, and any resulting damages, losses costs and expenses, regardless of whether the claim or demand arises under tort, contract, strict liability or other legal theories, arising from Customer’s unauthorized sale, use or reconfiguration of Gentex mirrors with Rear Camera Display systems or any use of such systems for purposes outside the defined Scope of Use. MITO Corporation will notify Customer promptly if and when MITO becomes aware of the basis for a claim under this paragraph.
2. Warranty. MITO Corporation IS RELIEVED OF ALL WARRANTY LIABILITY FOR GENTEX MIRRORS WITH REAR CAMERA DISPLAY SYSTEMS THAT ARE USED OUTSIDE OF THE DEFINED SCOPE OF USE.
3. Scope of Use. Rear Camera Display systems shall be used for the purpose of providing an auxiliary view of the scene directly behind a vehicle while in reverse to aid the driver while backing up.
